{"id":62549,"date":"2024-03-05T12:25:00","date_gmt":"2024-03-05T17:25:00","guid":{"rendered":"https:\/\/scoopmedia-develop.go-vip.net\/statescoop\/?p=62549"},"modified":"2024-03-05T00:24:08","modified_gmt":"2024-03-05T05:24:08","slug":"ai-state-privacy-practices","status":"publish","type":"post","link":"https:\/\/scoopmedia-develop.go-vip.net\/statescoop\/ai-state-privacy-practices\/","title":{"rendered":"State privacy chiefs are watching AI closely"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Privacy practices are in many states are only in their nascent phases, but three state chief privacy officers told StateScoop that <a href=\"https:\/\/scoopmedia-develop.go-vip.net\/statescoop\/tag\/artificial-intelligence-ai\/\">AI<\/a> will be a core concern as they scout for policy potholes and identify useful new tools.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indiana Chief Privacy Officer Ted Cotterill said his state may be the \u201cnew kid on the block\u201d when it comes to privacy policy, but privacy is getting more attention as state policymakers figure out how to use emerging technologies like generative artificial intelligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s a function of privacy that we\u2019ve been put front and center in Indiana\u2019s AI governance initiative,\u201d Cotterill said Tuesday during StateScoop and EdScoop\u2019s <a href=\"https:\/\/cybersecuritymodsummit.upgather.com\/\">Cybersecurity Modernization Summit<\/a>. \u201cI recently testified before our Interim Study Committee on Commerce and Technology around AI and what we expect state agencies to do and the constraints we want to put on those implementations to ensure we do it the right way. We want to adopt trustworthy AI with outputs that align with our values.\u201d\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the same session, Utah\u2019s <a href=\"https:\/\/scoopmedia-develop.go-vip.net\/statescoop\/privacy-culture-state-government-public-trust\/\">Christopher Bramwell<\/a> said the state must determine how to \u201cdo privacy\u201d in relation to a technology as new as generative AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn my view we have to watch it very closely,\u201d said Bramwell, Utah\u2019s chief privacy officer of government operations. \u201cWe\u2019re not going to hinder AI, but make sure privacy gets incorporated into how they\u2019re building out these AI architectures and solutions to ensure we can still meet our privacy obligations and adhere to those privacy principles<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Washington state Chief Privacy Officer Katy Ruckle said she intends to build on policies and practices already established by her state and federal agencies for other purposes, rather than start from scratch. She pointed to the executive order <a href=\"https:\/\/scoopmedia-develop.go-vip.net\/statescoop\/washington-governor-signs-ai-order-plotting-yearlong-policy-path\/\">Washington Gov. Jay Inslee signed<\/a> in January that directed 12 months of policy work, some of it based on various AI, cybersecurity and privacy frameworks established by the National Institute of Standards and Technology.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cotterill said that for all of Indiana\u2019s privacy work, not just with AI, it\u2019s important to align policies with the agencies\u2019 existing missions to encourage participation and compliance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey all have something they\u2019re already charged with,\u201d he said. \u201cWe have to do more with less, always. That\u2019s the expectation, so we come to them and say, \u2018Now you have to do privacy and you need to do governance. Our goal is really to articulate the value for the enterprise, maybe even for that business unit, and make it easy.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Utah, the state legislature is still deciding where to house the state\u2019s new privacy practice. Bramwell said that while existing state and federal policies and frameworks can be useful, privacy in Utah is sometimes challenged by the headstart enjoyed by its cybersecurity policies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c[Privacy is] happening naturally because we realize it\u2019s a big social issue of the time,\u201d Bramwell said. \u201cPart of the difficulty, and some of the pain, [is] we\u2019re having to build privacy when there\u2019s already an established cybersecurity strategy, so we\u2019re having to put a lot of emphasis into aligning our privacy strategy with cybersecurity. \u2026 There\u2019s a lot of pain points in that you have to get a uniform strategy in how to pull this all together.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The good news, Bramwell said, is that as with cybersecurity, Utah is pursuing an \u201call of state\u201d approach to privacy that could ensure a uniform approach to how
